According to the U.S. Department of Justice (DOJ), Rust is, “charged with the transmission in interstate commerce of a communication containing threats to injure the person of another.”

According to court documents, on Nov. 11, 2015, Rust used the Wi-Fi connection at a Panera restaurant in Alexandria, Va., to post a statement online, threatening to kill Blacks at Howard, one of the most prestigious HBCU’s (Historically Black Colleges and Universities), in the nation.

“Any ni—-s left at Howard University after 10 tomorrow will be the first to go…After all, it’s not murder if they’re Black,” Rust allegedly wrote, according to the Washington Post.

After Rust’s conviction in 2012 in Loudon County, Va., for aggravated sexual battery and indecent indecent liberties with a child by a custodian, Rust was barred from using the internet because he was a registered sex offender, the Post reports. Rust allegedly admitted to using the internet in 2015, which violated the terms of his probation.

According to the DOJ, Rust appeared before U.S. Magistrate Judge Theresa C. Buchanan Oct. 5, at the federal courthouse in Alexandria for a preliminary and detention hearing. He faces a maximum of five years in prison if convicted.
